Misdemeanors

A misdemeanor is a crime, which carries a maximum of 365 days in jail, and a $5000.00 fine. Misdemeanor cases are filed and prosecuted in the District Courts. A defendant has the right to be represented by counsel, and may have the matter tried before a jury of six of his or her peers. Some examples of misdemeanor crimes are Theft (under $250.00), Assault in the Fourth Degree, Reckless Driving, Driving While License Suspended and Driving While Intoxicated (DWI). A misdemeanor charge, while not as serious as a felony, carries with it a possibility of a jail sentence. In representing a person who has been accused of a misdemeanor, we recognize that the client may experience a great deal of guilt, stress and anxiety, especially if the client has never been involved with the criminal justice system. Quite often, a misdemeanor case may be resolved through alternative means. These alternative options are available for less serious offenses and for first time offenders.
