FAMILY LAW

What is the difference between a legal separation and a divorce?
The process and laws are similar. The only difference is in how quick it can be over and your status at the end of the proceedings. At the conclusion of either process, a decree will be entered. That decree will alter your status. You will either be a single person who had experienced a divorce or you will be married and legally separated.

What is the quickest that I can be divorced?
The shortest divorce takes 90 days after service of the initial documents have been completed on the other party.

Usually the process takes four months to a year. It could take longer if there is difficulty or shorter if there is agreement between the two parties.

How much does it cost?
The cost varies but the basic filing fee with the court is $250 and the attorney's fees and other costs generated are based upon the amount of work done. If parties have children, significantly more issues and work is involved because of the requirement for entry of a Parenting Plan and Child Support Order. A basic deposit is usually in the $2000 to $4000 range for a divorce without children and $3000 to $5000 for a divorce with children, depending on a variety of factors. My hourly rate is $200.
